Can I take him to court?

  • My sister's (now) ex-boyfriend stole over $500.00 for me. I was missing money back in June and so me and my brother set up a camera to see if he would take more money. That time, instead of going in my room, he went inside my brother's room snooping around and we also caught him panicking and trying to change the tape of the camera. (You can see his face).

    After we confronted him a month and a half ago, our family talked and he promised that we'd get our money and he was sobbing. Whatever, so far I only got $100...and I texted him when he will bring more money. he keeps telling me he will bring more but never does and now he has stopped replying to my texts. I text him about every two weeks about it.

    If he doesn't pay back at all, can I take him to court? And what are the chances of winning if I have msgs from him saying he will pay back, have him snooping on video, and my whole family knowing about it?


  • If you do decide to go to court, you should take him to small claims court (no lawyers). With the messages saying he owes the money you are almost certain to win. If he doesn't show up you will win by default.

    However, since you may have a hard time collecting on the judgment you should continue trying to get him to pay you back before you file the case.

    Go to your counties website to find info about the steps you must follow before filing a small claims case.


  • Theft is a Police matter. Tell them about what happened and show the video tape to them and they will decide to prosecute him or not on this evidence.


  • This is a criminal case. I would turn him in to the local police department with all the evidence that you have and let them prosecute him.


  • I'd take him to small claims court. You might win, but usually their rulings have no enforcement.

    You'd spend more money on lawyers than the camera is worth if you tried the conventional court system.


  • Tell him you are going to get him arrested and see what the crybaby thief does then! Even small claims court will cost a little money and take some time away from you.

    You can sell the tape to some TV show and expose this scumbag to everyone! (Or at least threaten to sell that tape to a TV station!) Some TV stations have reporters who try to resolve problems for people, something on tape may be what they want to use!

    Keep copies of your text messages saying he will pay everyone, they will be helpful when you go to court!

  • if you have the messages still and proof that he stole the money in the first place then yeah you can take him to court and you will have a good chance at winning just make sure you have all the evidence.
